1ST OFFENSE Driving While Suspended in NJ*
A fine of $500.00, and up to 6 months additional license suspension. In addition, MVC surcharges

2ND OFFENSE Driving While Suspended in NJ*
A fine of $750.00, up to 6 months additional license suspension and imprisonment for a term of up
to 5 days. In addition, MVC surcharges will apply along with increased insurance costs. Note

3RD or SUBSEQUENT OFFENSE Driving While Suspended in NJ*
A fine of $1,000 and shall be sentenced to imprisonment for not less than 10 days and up to 6

The Criminal Charge of Driving While Suspended: 2C:40-26(a and b)
The State of NJ has a criminal charge for drivers caught driving on a suspended license but this
summons is only issued if:
1) The person was driving while he was suspended due to a previous 39:3-40 and was intoxicated at
the time he was stopped or
2) The person was caught driving while under a suspension for a 2nd or subsequent violation of a DWI
A violation of this criminal charge will result in the actor being charged with a 4th degree criminal offense which
includes jail of up to 18 months of which 180 days must be served in jail. We can help!
